This is the question we get more than any other: "Can we drink on the party bus?" The answer in Texas is yes — with the right conditions met. Here is the legal framework so you understand exactly where the line is:


What the Texas Law Actually Says

Texas Transportation Code Section 49.031 prohibits open containers of alcohol in motor vehicles. However, Texas Alcoholic Beverage Code Section 28.10 creates an explicit exemption for passengers (not the driver) on a licensed chauffeured vehicle operated by a holder of a charter bus or limousine authority.
